PROGRAMME TERMS AND CONDITIONS
1. KAI TAK SPORTS PARK MEMBERSHIP PROGRAMME
1.1. The Kai Tak Sports Park Membership Programme (“KTSPMP”), also known as the Friends of KTSP, is managed and operated by Kai Tak Sports Park Limited (“KTSPL”) and is governed by the terms and conditions set out herein (“Terms and Conditions”).
1.2. The submission of an application for membership of the KTSPMP is deemed to be an acceptance of these Terms and Conditions.
1.3. Upon becoming a Member of the KTSPMP, the Member shall continue to be bound by these Terms and Conditions.
2. DEFINITIONS
2.1. Kai Tak Sports Park (“KTSP”) means the entire precinct of Kai Tak Sports Park, located at 38-39 Shing Kai Road, Kai Tak, Kowloon.
2.2. Hong Kong means the Hong Kong Special Administrative Region of the People’s Republic of China.
2.3. KTSP Website means the KTSP website at www.kaitaksportspark.com.hk.
2.4. KTSP Mobile App means the KTSP mobile application or other mobile application(s) for use by the Members for the purpose of the KTSPMP.
2.5. KTSPMP means the Kai Tak Sports Park Membership Programme operated and managed by KTSPL which is also called “Friends of KTSP”.
2.6. Member means a person admitted by KTSPL to be a member of the KTSPMP, subject to these Terms and Conditions and the term “Membership” shall be construed accordingly.
2.7. Membership QR Code means a designated membership QR Code issued to a Member for enjoyment of the Benefits.
2.8. Benefit(s) maans any goods, services, benefits, privileges, promotions, offers, rewards or the like offered or to be offered to Members by KTSPL or any third parties (including but not limited to the Designated Merchants/Service Providers as defined in Clause 2.11 hereinbelow) under the KTSPMP from time to time.
2.9. Retail includes all Designated Merchants/Service Providers in the shopping malls and dining cove within KTSP.
2.10. Eligible Transaction(s) means any e-payment made for products/services from Designated Merchants/Service Providers within KTSP.
2.11. Designated Merchants/Service Providers means any merchant/service provider who offers or will offer goods, services, benefits, privileges, promotions, offers, rewards or the like to the Members under the KTSPMP subject to the applicable terms and conditions, whether specified herein or otherwise. The list of such merchants/ service providers may be updated by KTSPL from time to time according to different events and promotions.
2.12. A reference to one gender includes a reference to all genders.
2.13. Words in the singular include the plural and vice versa.
3. MEMBERSHIP AND ELIGIBILITY
3.1. Any individual aged 15 or above is eligible to apply for Membership. Minors (i.e. individuals under the age of 18) are required to obtain the consent of a parent or legal guardian to apply for Membership and join the KTSPMP. By accepting these Terms and Conditions, the minor confirms that he has obtained consent from his parent or legal guardian.
3.2. The registered name for Membership shall be the same as the applicant’s name in his official identity document and KTSPL shall have the right to seek verification from the applicant. Each individual is only entitled to have one (1) Membership account at any given time.
3.3. KTSPMP Membership has a lifetime validity period unless terminated pursuant to these Terms and Conditions or deleted as requested by the Member.
3.4. Membership and Benefits are non-transferable and may only be used or enjoyed by the individual to whom the Membership and the Benefits are granted or issued.
3.5. KTSPL reserves the right to modify the structure, benefits, contents and other features of the KTSPMP, including but not limited to the KTSP Website, the KTSP Mobile App, the Membership, the Benefits and these Terms and Conditions, at any time without prior notice. Although KTSPL will use reasonable efforts to notify Members of material changes to the KTSPMP and/or to these Terms and Conditions, it is the responsibility of Members to keep themselves up to date in respect of the KTSPMP and these Terms and Conditions. KTSPL will not be liable for any loss or damage resulting from any modifications to the KTSPMP, including but not limited to these Terms and Conditions.
3.6. Each Member will be assigned a Membership account. Member must ensure that his Membership account details including but not limited to the password, Membership number, as well as any QR Codes representing his Membership are kept confidential and are not disclosed to any third parties. Member is fully responsible for any use of his Membership account by any persons and KTSPL shall not be liable, in the event that a third party obtains access to a Member’s account to make transactions, whether with or without authority of the Member.
3.7. KTSPL shall have the right to audit a Member's account at any time without prior notice to the Member to ensure compliance with these Terms and Conditions, and any other applicable rules, regulations, terms and conditions or applicable laws. During the course of an audit a Member’s account may be temporarily suspended and the Member may not be permitted to access his account nor perform any transactions. KTSPL excludes all liability for any loss or damage resulting from such suspension of Member’s account.
4. MEMBERSHIP QR Code
4.1. A designated Membership QR Code will be assigned to a Member upon his successful application. KTSPL and the Designated Merchants/Service Providers are entitled to request a Member to present his Membership QR Code when he claims any Benefits, or makes any request in relation to his Membership or the Benefits.
4.2. Without prejudice to the right of KTSPL to seek verification under Clause 3.2, KTSPL and the Designated Merchants/Services Providers are entitled to assume without proof that the bearer of a Membership QR Code is the Member named thereon.
5. ELIGIBLE TRANSACTION
5.1. Only Eligible Transactions by a Member settled by electronic payment at a Designated Merchant/Service Provider in KTSP shall qualify for Member’s Benefits. An Eligible Transaction excludes the following:
1) any single spending below HK$50;
2) any spending in cash;
3) any payments using physical or electronic cash vouchers/coupons or gift cards/vouchers/coupons of KTSPL;
4) any payments using physical or electronic cash vouchers/coupons, gift cards/vouchers/coupons, stored value cards or pre-paid cards of merchants in shopping malls within KTSP;
5) purchase of any kinds of membership(s);
6) any purchase of pre-paid items, cash vouchers/coupons, gift cards/vouchers/coupons, stored value cards or pre-paid cards);
7) any purchase of show/event/concert/exhibition tickets and other ticketing services and any payments of venue or facility booking;
8) any payment of medical and dental/clinic services;
9) adding value to Octopus cards, stored value cards or pre-paid cards;
10) currency exchange;
11) any transaction on the KTSP e-Shop on the KTSP Website, food ordering via the KTSP Website, KTSP Mobile App or any online platform of any Designated Merchants/Service Providers;
12) charity donations;
13) tips towards any spending or purchases;
14) any bill payment (including but not limited to payment of telecommunication or utility bills);
15) any bank, insurance and securities & investment transactions;
16) any spending at travel agencies and property agencies;
17) any activity, programme or course provided or hosted by KTSPMP or external third parties;
18) any spending of parking or purchase of parking card;
19) any spending in exhibition venues and booths and temporary pop-up stores;
20) EPS cash withdrawal receipts, credit card withdrawal receipts and receipt copies are not eligible;
21) any spending at particular merchants as stated in the Terms and Conditions (which may be updated from time to time without prior notice).
5.2. These exclusions from Eligible Transactions in Clause 5.1 may be amended and updated for particular events or promotions.
6. PROOF OF SPENDING
6.1. KTSPL will only accept original machine-printed receipts or invoices from Retail as proof of accumulated spending under Eligible Transactions by the Member. Payment slip of credit card, debit card, Apple Pay, Android Pay, Samsung Pay, WeChat Pay, Alipay, Quick Pass, Tap & Go, PayMe, EPS or any form of digital or smart device payment shall be presented by the Member to KTSPL. KTSPL has the right to verify that the name of the Member on such payment slip is the same as the registered name for his Membership account, payment card/account and/or official identity document.
6.2 KTSPL does not accept reprinted, handwritten and photocopied receipts or invoices. The payment must be made by the Member himself and KTSPL shall have the right to seek verification from the Member. For the avoidance of doubt, Members may not use sales receipts, electronic payment slips or other purchasing information/ document of any other individuals as proof of accumulated spending under Eligible Transactions.
6.3. KTSPL is entitled to make copies of the receipts, invoices or payment slips produced by the Member to KTSPL for audit purpose.
6.4. KTSPL is entitled to reject any receipts, invoices or payment slips that KTSPL suspects to be invalid, forged, fraudulent, unsettled, withdrawn or not issued for genuine transactions. KTSPL has the right to determine and verify the validity and applicability of any receipts, invoices or payment slips. KTSPL reserves the right to request Member to re-submit the receipts, invoices or payment slips or submit further documents or evidence of spending in relation to the Eligible Transaction(s). Member should keep the relevant documents submitted until the Benefits are confirmed. In the event of disputes, the decision of KTSPL shall be final and binding on the Member and other parties involved.
6.5. KTSPL is entitled to mark on the original receipts, invoices or payment slips used for earning accumulated spending by the Member. Unless otherwise specified, the receipts, invoices or payment slips marked by KTSPL cannot be used by the Member again to participate in any other activities of KTSPL and/or to redeem any other Benefits.
7. REDEMPTION AND ENJOYMENT OF BENEFITS
7.1. A Member may only claim or redeem Benefits at designated locations or through the designated channels as may be specified by KTSPL from time to time. KTSPL is entitled to make the final decision in relation to the Benefits. Members shall be subject to the terms and conditions as may be applicable to any Benefits from time to time.
7.2. All Benefits are offered subject to availability while stocks last (if applicable).
7.3. KTSPL is entitled to grant Benefits to a Member only when the Membership account of this Member is valid and in good standing as recognised by KTSPL.
7.4. Once KTSPL has accepted any redemption request from a Member, the redemption request by the Member cannot be changed or cancelled.
7.5. A Member shall forthwith inform KTSPL of any Eligible Transaction where Benefits have been obtained/redeemed but such Eligible Transaction is subsequently cancelled, refunded or reversed for whatever reasons. In such circumstances, or if the Member fails to inform KTSPL but it has come to the knowledge of KTSPL of those cancelled, refunded or reversed Eligible Transaction(s), KTSPL reserves the right to reverse/deduct the relevant amount of accumulated spending and/or Benefits from Member's account or request the Member to pay to KTSPL forthwith upon notice from KTSPL for the face value of the Benefits, which shall be determined by KTSPL in its sole and absolute discretion.
7.6. KTSPL and Designated Merchants/Service Providers are entitled to request a Member to present his Membership QR Code and, if necessary, other identification documents for verification of identity when the Member claims or redeems any Benefits.
7.7. Employees and owners of the Designated Merchants/Service Providers who are also Members are not eligible to claim or redeem the Benefits from the purchase(s) made from their own shops. KTSPL shall have the right to reject or invalidate any Benefit redemptions made by such individuals.
8. BENEFITS & REWARDS REDEMPTION
8.1. KTSPL may issue a one-time QR code for specific rewards via the Member’s registered email or the said QR code may be stored in the Member’s KTSPMP account on the KTSP Mobile App upon successful redemption. The issued QR code entitles the holder to redeem the reward within the designated validity period at designated locations or through designated channels as specified by KTSPL. The validity periods of redeemed rewards may vary for different rewards and may be subject to additional terms and conditions.
8.2. The said QR code may be made available for certain rewards on the KTSP Mobile App. Members may redeem rewards subject to the applicable terms and conditions from time to time.
8.3. All prices listed for redemption are denoted in Hong Kong dollars. All payments must be settled in Hong Kong dollars only.
8.4. Members may submit requests for redemption of rewards through the KTSP Website, the KTSP Mobile App or any other platform as may be specified by KTSPL from time to time. KTSPL may accept or reject such requests according to (amongst others) whether such Member has successfully processed any required payment for the redemption and whether the reward is still available.
8.5. If an online redemption request is accepted by KTSPL, a redemption notification with a QR code will be sent to the Member by e-mail or via the KTSP Mobile App. If a Member fails to collect his reward in accordance with the instructions specified in the redemption notification before the expiry of the said QR code, he will be deemed to have forfeited his right to collect the reward.
8.6. A Member shall present his original and valid Membership QR Code for inspection at the time of redemption.
8.7. Rewards are offered on a first-come-first-served basis and shall be available while stock lasts.
8.8. Rewards and QR codes have no cash value and cannot be exchanged for cash or other gifts. Rewards cannot be sold, purchased, assigned or transferred.
8.9. Specific terms and conditions may apply to each reward and issued QR code.
8.10. For the redemption terms, conditions and quantities of individual event rewards, please refer to the relevant event terms and conditions.
9. DELETION, SUSPENSION OR TERMINATION OF MEMBERSHIP
9.1. Members may withdraw their Membership at any time by giving written notice to KTSPL or through the KTSP Mobile App.
9.2. KTSPL is entitled to forthwith suspend or terminate the Membership of any Member and/or withdraw any or all Benefits from the Member if KTSPL believes that the Member has misused the Membership (including any QR Codes, accounts or Benefits), breached any of these Terms and Conditions or has not complied with the instructions of KTSPL in connection with KTSPMP. In addition, KTSPL shall have the right to forthwith suspend or terminate the Membership of any Member at any time at the sole and absolute discretion of KTSPL without any reasons or compensation. KTSPL shall not be liable for any loss or damage resulting therefrom suffered by any party in any circumstances.
9.3. KTSPL is entitled to cancel all Benefits of a Member forthwith upon termination of his Membership for whatever reasons without any compensation.
9.4. Termination or suspension of Membership or withdrawal of Benefits for whatever reasons shall not prejudice any accrued rights and remedies of KTSPL and/or the Designated Merchants/Service Providers as at the date of termination.
9.5. Members cannot enrol for Membership again using the same email and/or mobile number within six (6) months upon Membership deletion or termination. A new membership number will be assigned in case of any re-enrolment, and the Membership account will be deemed as a new Membership account without any association with the previous account.
9.6. If a Member is deceased, his Membership account shall be closed and all Benefits (if any) shall be cancelled by KTSPL with effect from his death without any compensation.
10. DISCLAIMERS AND EXCLUSION OF LIABILITIES
10.1. KTSPL and/or Designated Merchants/Service Providers shall not be liable to Members for any direct, indirect or consequential loss, damage or expense of any kind whatsoever arising out of or in connection with the KTSPMP (including but not limited to the refusal by KTSPL and/or Designated Merchants/Service Providers to allow any Member to register his spending as an Eligible Transaction or claim any Benefits or rewards). Such exclusion of liability applies whether the loss, damage or expense is caused by negligence or otherwise, and whether KTSPL and/or Designated Merchants/Service Providers have any control over the circumstances giving rise to the claim or not.
10.2. A Member is hereby deemed to have read, understood and agreed to these Terms and Conditions, and confirms that he has not relied on any statement, representation, assurance or warranty made by KTSPL and shall waive all of his rights, if any, against KTSPL in relation thereof.
10.3. Without prejudice to Clause 10.2 hereinabove, KTSPL does not give any warranty on the quality or fitness for purpose of any of the Benefits and accepts no responsibility in respect of the following:
1) refusal by KTSPL, and any Designated Merchants/Service Providers to offer Benefits or accept the Membership QR Code;
2) unavailability of any of the Benefits; and
3) refusal of replacement or change of any of the Benefits or compensation or reward thereof by KTSPL and/or any Designated Merchants/Service Providers.
10.4. KTSPL shall not be liable for any loss arising from the failure by Designated Merchants/Service Providers to provide any products, services or Benefits. Where a Member uses the services provided by Designated Merchants/Service Providers, their terms and conditions shall apply in addition to these Terms and Conditions and KTSPL shall not be liable for any loss arising therefrom.
10.5. In case of any disputes between the Member and the Designated Merchants/Service Providers, the parties shall resolve the disputes amongst themselves. KTSPL shall have the right not to be involved in the dispute and the exercise of such right by KTSPL shall not prejudice any rights of KTSPL under these Terms and Conditions.
10.6. Designated Merchants/Service Providers may impose additional terms and conditions in respect of the Benefits available to the Member. Members agree to be bound by such additional terms and conditions in respect of the Benefits.
10.7. All terms expressed or implied by statute or otherwise on the part of KTSPL and/or Designated Merchants/Service Providers are hereby excluded to the fullest extent permitted by law. For the avoidance of any doubt, nothing in these Terms and Conditions shall exclude liability for death or personal injury caused by negligence.
11. GENERAL CONDITIONS
11.1. KTSPL shall deal with all personal data in accordance with the Personal Data (Privacy) Ordinance (Cap 486 of the Laws of Hong Kong) and the KTSP Privacy Policy Statement. Please refer to the Privacy Policy Statement of KTSPL here: www.kaitaksportspark.com.hk/PrivacyPolicy.
11.2. A Member shall consent to the Personal Information Collection Statement of KTSPL during the application for Membership which sets out the practices of KTSPL in respect of its collection, holding and use of personal data in relation to the KTSPMP.
11.3. If a Member has any questions or wishes to access or correct his personal data held by KTSPL, please contact the Personal Data Privacy Officer of KTSPL by email at [email protected].
11.4. The use of the KTSP Website, the KTSP Mobile App and facility is governed by the applicable terms and conditions and the Privacy Policy Statements of the KTSP Website, the KTSP Mobile App and facility.
11.5. KTSPL shall have the right and sole and absolute discretion to amend, delete, modify and/or vary any of these Terms and Conditions, including but not limited to imposing additional terms in respect of the Membership, the Membership QR Code, the Benefits and other matters in relation to the KTSPMP from time to time without prior notice. Should there be any inconsistencies between these Terms and Conditions and those additional terms and conditions, those additional terms and conditions shall prevail.
11.6. KTSPL is entitled to transfer, assign, charge, sub-contract or otherwise dispose of any of the rights or obligations under these Terms and Conditions and the KTSPMP on such terms and conditions as KTSPL may at its sole and absolute discretion think fit at any time without any prior notice to the Member.
11.7. KTSPL is entitled to amend, suspend and terminate the KTSPMP at any time without any prior notice, reason or compensation. KTSPL shall not be liable for any loss or damage resulting therefrom by any party in any event.
11.8. Any failure to enforce a particular term herein by KTSPL does not constitute a waiver of that term.
11.9. All parties agreeing to these Terms and Conditions do not intend that any term of these Terms and Conditions should be enforceable or enjoyed, by virtue of the Contracts (Rights of Third Parties) Ordinance (Cap 623 of the Laws of Hong Kong), by any entity or person who is not a party to these Terms and Conditions. The consent of any entity or person who is not a party to these Terms and Conditions is not required to rescind or vary these Terms and Conditions.
11.10. KTSPL has the right to interpret these Terms and Conditions and its interpretation shall be final and binding on all parties concerned.
11.11. The Chinese version of these Terms and Conditions is provided for reference only. In the event of any discrepancy between the English version and the Chinese version, the English version shall prevail.
11.12. These Terms and Conditions shall be governed by the laws of Hong Kong and any disputes arising from, out of or in relation thereto, shall be subject to the exclusive jurisdiction of the Hong Kong courts.
